(Real Estate, Stock & Station and Business Agents)

Under the Agents Act 2003, all property managers and sales employees of licensed agents must be registered.

Who has to be registered?

Registration applications will be processed against three criteria. Employees need to:

  • prove they meet competency qualifcations. These can be prescribed educational standards or experience based. An independent assessment panel may consider each applicant's circumstances
  • be of suitable character and without public objection
  • undertake on-going professional development.

Who needs a licence?

A real estate agent requires a licence to operate their own agency or to manage an office or branch of a corporation. Licensees will need to:

  • prove they meet competency qualifications;
  • be of suitable character
  • undertake on-going professional development.
  • Licenses are issued by the Commissioner for Fair Trading.

Under the principles of mutual recognition, licensed or registered agents from other states can seek recognition of their qualifications in the ACT. They cannot commence employment until their licence application or registration has been processed.

Company licences

At least one director of a company applying for a corporate licence must hold a personal licence. Each director must not be disqualified from being eligible for a licence.

A company licence must nominate a licence holder who will supervise business operations.

Conditional Licences and Registration

Conditional licences are issued to assist people for specific periods while they are finalising their qualifications.

The Commissioner for Fair Trading can approve registration or issue a licence with specific conditions.

These conditions will appear on the licence or registration documents. Failure to observe these conditions is an offence.
