The Office of Regulatory Services is responsible for the licensing of hawkers in the A.C.T.
A hawker is any person that sells or offers to sell goods carried on his person or on a vehicle. A person must hold a hawker's licence if trading in a location for longer than 30 minutes. The only exception is where a person is trading within the boundaries of an established marketplace or fair, in which case permission is required from the manager of the venue.
You may apply for a hawker's licence by completing an Application for a Hawker's Licence and paying the prescribed fee.
Hawker's licences do not apply to public land that is on 'national land' under the control of the National Capital Authority (NCA). Inquiries about conducting business on national land should be referred to the NCA.
A licence may be granted for a period not exceeding 1 year. The term of the licence will be specified on the licence, and a renewal notice will be sent to you 1 month prior to the expiry of the licence.
A licence may be suspended or cancelled where reasonable grounds exist, such as not carrying on business in accordance with the licence or within the law. A licence may be suspended or cancelled where the licensee has committed an offence against the Act, whether or not the licensee has been convicted or found guilty of an offence for the contravention.
