APPLYING FOR A MOTOR VEHICLE DEALERS LICENCE
ARE YOU ELIGIBLE FOR THIS LICENCE?
The Sale of Motor Vehicles Act 1977 and Sale of Motor Vehicles Regulations 1977 determine eligibility for a Vehicle Sale Licence (commonly known as a Motor Vehicle Dealer’s Licence).
Sections 8 and 9 of the Act deal with eligibility of individuals and corporations:
- If you are an individual, you must be an adult (18 years of age or older)
- You must be of good fame and character (if the applicant is a corporation then each of the directors must be of good fame and character)
- You are able to comply with obligations applicable to the licence
- You do not hold a car market operators licence
- You have sufficient material and financial resources to carry on the business AND
- You intend to carry on the business during the period of the licence
In addition, you must provide:
- Two (2) written references as to the fame and character of the individual applicant (and for each director of a corporation)
- A certificate from ACT Planning and Land Authority (ACTPLA) that the provisions of the Territory lease, for each place where you propose to carry on business under the licence, do not prohibit such business
- If you are an individual - statement audited by a qualified accountant containing details of your material and financial resources
- If you are a corporation that has been in existence for less than 1 year a copy of the corporations accounts from time of incorporation to no more than a month before date of application for licence
- If you are a corporation that has been in existence for more than 1 year a copy of the corporations account for the previous financial year and for the current financial year up to not more than a month before date of application for licence
You must also notify the public of your application in a daily newspaper circulating in the ACT within 7 days before lodging your application. You must supply us with a copy of the advertisement.
A licence may be held by an individual or by a corporation and can be issued for a period of up to one year. In practice, all licences expire on 30 November (unless issued for a shorter period) and must be renewed on or before that date.

FORMS OF PERSONAL IDENTIFICATION
You must provide two (2) forms of personal ID for each individual, or each executive officer see Infotext G 01. We must see the original documents. We will copy these and retain only the copies.
POLICE RECORDS CHECK
Each individual, or director if the applicant is a corporation, must obtain and lodge with the application a National Police Check from the Australian Federal Police. Corporations must also obtain and lodge a National Police Check.
LICENCE AND POLICE CHECK FEES
You must pay for the police records checks at the time of lodging your National Police Check application with the Australian Federal Police. We will contact you by telephone or email when we have decided your eligibility to be issued with a licence. We will advise you about the fees you must then pay to us for the issue of your licence. We only accept payment by cheque, money order or cash.
